Be sure to read the part about IBM unwilling to indemnify its
Linux customers running IBM binaries, at least HP is.

The counterclaim game is one of limiting losses directly related to
damages and practices, especially the treble punative awards. IBM
is still way on the losing end of the stick if the court properly
upholds unfair reverse engineering practices in moving UNIX code
to Linux.

This particular counter claim is really a swamp for IBM, as it
attempts to tie the actions of one SCO division (the UNIX properties)
to the old Caldera linux division which was operated with separate
staff as an arms length business unit. Since the IBM code in
question was already released GPL, the real dollar value is in
serious question as an offset to the original SCO claim.

What will be more interesting, will be to read the IBM rebuttals,
if any other than boiler plate, to the outstanding SCO claims
as this goes to trial.
