That was not what was stated or implied.  Judges are required to see
convincing evidence before the case is allowed to proceed. Given that
evidence, the defendent is then allowed the chance to address each piece
of evidence, and discredit it (if possible) or offer other allowable
defenses.

There are those strongly asserting that SCO doesn't have a case at all,
which flies in the face of the facts, that at least the presiding judge
thought so to allow the case to proceed into discovery.
