I suspect that it could have also been damaging to IBMs suit if they had
done that.  See how SCO spun it as it was.  First saying "There must be
IP issues if these companies won't indemnify their users!"  Then when HP
ofered it, SCO said "There must be IP issues because they offered
indemnification!".
